Terms and Conditions

These Terms and Conditions ("Terms") govern your use of the services provided by OFAP (Open Funding Alliance & Platform), operated by OFAP. By accessing or using our website and services, you agree to these Terms. If you do not agree with any part of these Terms, you must refrain from using our services.

1. Scope of Services

Platform and Alliance Services

OFAP offers services under the Platform and Alliance tiers, which may include the following (or more):

  • Access to information on EU funding opportunities

  • Invitations to online events, webinars, and information sessions

  • Tailored notifications about new EU funding opportunities

  • Access to the annual OFAP event

  • Ongoing information and updates on EU funding programs

  • Support for creating and submitting EU funding applications

  • Development of a customized funding roadmap

  • Ongoing project management and reporting for EU projects

  • Quarterly strategic reviews to optimize funding strategy

  • Access to exclusive strategic funding events and networking opportunities

Disclaimer: All services provided are subject to the availability of resources and may be adjusted or modified at OFAP's discretion. The effectiveness of the services is contingent upon the accuracy and completeness of the information provided by the member. OFAP makes no guarantees regarding the success of any funding applications or the availability of specific funding opportunities.

2. Membership and Account Creation

To use OFAP services, you must apply for a membership account (Platform or Alliance or Partner) and, if accepted as such, provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. If you suspect unauthorized use of your account, you must notify OFAP immediately.

3. Payments and Fees

  • Platform Membership Fees: Platform services are charged on an annual basis, as outlined on the website or otherwise agreed.

  • Alliance Membership Fees: Alliance packages are charged monthly, with the specific cost varying based on the level of service selected.

  • Partner Fees: Partner fees will be discussed and agreed upon separately.

Annual Price Adjustments:
OFAP reserves the right to adjust pricing annually to reflect inflation or other relevant cost changes. Price increases of up to 7% annually will not entitle users to terminate the agreement. Any increases exceeding 7% will provide users with the right to terminate their membership within 30 days of receiving notification of the price change.

4. Data Collection and Privacy

For information regarding how your personal data is collected, stored, and processed, please refer to our Privacy Policy, which forms an integral part of these Terms.

5. Intellectual Property

All content, materials, and resources provided by OFAP, including logos, graphics, written materials, and any intellectual property, are the property of OFAP or licensed to us. You are not permitted to reproduce, distribute, or otherwise use this content without prior written consent, except as described below.

When OFAP creates member-specific content (such as EU funding applications, one-pagers, or other client materials) as part of our services, the copyrights for this content will be transferred to the member, provided all payments have been completed. If payments are not fully made, the copyrights remain with OFAP. This applies to all member-specific content; however, any general content (not tailored to the individual member) remains the property of OFAP.

6. User Obligations

By using OFAP’s services, you agree to:

  • Provide accurate and complete information during the registration process.

  • Not misuse or disrupt the website or services.

  • Comply with all applicable laws and regulations when using OFAP services.

  • Not engage in activities that could harm OFAP's systems or reputation.

7. Limitation of Liability

OFAP strives to offer high-quality services. However, we make no guarantees regarding the accuracy, availability, or results of the services provided. To the fullest extent permitted by law, OFAP disclaims any liability for indirect, incidental, special, or consequential damages arising from the use or inability to use our services, including, but not limited to, loss of data, revenue, or reputation.

While OFAP makes reasonable efforts to ensure the security and reliability of our services, we cannot guarantee that the services will be free from errors or interruptions. You acknowledge that your use of the services is at your own risk. OFAP is not liable for any direct, indirect, or incidental damage arising from third-party actions or events outside our control, including technical failures, loss of access, or changes in applicable laws or regulations.

8. Termination of Services

We reserve the right to suspend or terminate your access to OFAP services at our discretion, particularly if you breach these Terms. You may terminate your membership by contacting us directly, and your access will be revoked once your request is received.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of Germany. Any disputes arising from these Terms will be resolved through binding arbitration or, where applicable, in the competent courts of Groß-Gerau, Germany. In cases where these Terms conflict with applicable laws, the laws will override these Terms.

10. Changes to Terms

OFAP reserves the right to modify or update these Terms at any time. Any changes will be posted on this page with an updated effective date. Your continued use of our services after any changes constitutes your acceptance of the revised Terms.

12. Applicability to Partners

The Terms and Conditions also apply to Partners unless otherwise agreed separately. If any special agreements are made, those agreements will override these Terms.
